This action is for a permanent injunction. The action was commenced in August, 1971. A temporary restraining order was issued simultaneously with the commencement of the action and pending a hearing on an order to show cause for such continued temporary relief, which restraining order required the defendants-appellants (the National Farmers Organization, Corning, Iowa; Norbert Conners, Viroqua, Wisconsin, designated representative of NFO; Allen Skroch, Independence, Wisconsin; and Eralen Strey, Augusta, Wisconsin) to desist from inducing or attempting to induce producer members of the plaintiffs-respondents (Pure Milk Products Cooperative, Fond du Lac, Wisconsin; and Associated Milk Producers, Inc., a Kansas corporation) to breach, repudiate or terminate their contracts with the plaintiffs until that hearing. The hearing was postponed several times through various motions of the defendants and plaintiffs. The hearing was actually held on May 22-26, 1972. At the close of that hearing the temporary restraining order was continued in effect until the court could render its decision on the motion for a temporary injunction. This decision was entered in July, 1973. In September, 1973, the defendants filed an application for a substitution of Judge. The request for substitution was denied in October, 1973. The defendants appeal from the granting of the temporary injunction and have brought a separate petition for an alternative writ of mandamus to compel Judge Jerold E. Murphy to honor the request for a substitution of Judge.
